CDM principal designer in Hampstead

Short answer
If your project in Hampstead will involve more than one contractor, including subcontracted trades that never overlap, regulation 5 of CDM 2015 requires you to appoint a CDM principal designer in writing before construction begins. ClearCDM takes that appointment on residential and smaller commercial projects, on a fixed fee from £750 plus VAT. If nobody is appointed on a domestic project, regulation 7(2) puts the role on the designer in control of the pre-construction phase, whether or not anyone has discussed it.

What tends to matter on Hampstead projects
Hampstead is largely covered by conservation area designation, and Camden operates article 4 directions across parts of it that remove permitted development rights other areas take for granted. The stock runs from Georgian and early Victorian houses on the village streets to large detached and semi-detached Victorian villas on the slopes, with a great deal of subdivision into flats.
- Basements are a live local issue. Camden's own basements guidance identifies Hampstead as a hotspot for basement construction, and the council's local plan policy A5 and its basements planning guidance set out what a basement impact assessment has to cover. For a CDM appointment that matters because the temporary works, the sequence and the effect on the neighbouring structure are design decisions that reach the contractor as information or not at all.
- Slope and retained ground. Building into a hillside means retaining structures, split levels and excavation next to something that is already holding earth back.
- Large houses in multiple occupation. Subdivided villas mean other people's homes on the other side of the work, shared entrances, and escape routes that pass through the site.
- Mature trees and constrained plots. Access for plant is frequently the binding constraint, and the answer is usually to design the logistics rather than to improvise them.

This is the CDM role, not the Building Regulations one
Since October 2023 England has had a second principal designer role, under Part 2A of the Building Regulations 2010. It is a separate appointment about designing to meet the Building Regulations, and ClearCDM does not provide it. Most projects that need one need both. The difference in full.

Who appoints the principal designer on a Hampstead flat refurbishment?
The client, in writing, wherever more than one contractor is involved. If the flat is your own home you are a domestic client and regulation 7 moves most of your other duties to the principal contractor. If you are a landlord, the work is connected with a business and the full client duties in regulation 4 stay with you.
