CDM principal designer in Highgate

Short answer
If your project in Highgate will involve more than one contractor, including subcontracted trades that never overlap, regulation 5 of CDM 2015 requires you to appoint a CDM principal designer in writing before construction begins. If nobody is appointed on a domestic project, regulation 7(2) puts the role on the designer in control of the pre-construction phase, whether or not anyone has discussed it.

What tends to matter on Highgate projects
Highgate is unusual administratively: the conservation area spans three boroughs, Camden, Haringey and Islington, and the borough boundary runs down the middle of the High Street itself. The stock includes late Georgian and Victorian terraced development around the village core, with Highgate Hill running steeply down to Archway Road.
- Which council you are dealing with can change across a street. The boundary running through the High Street is not a curiosity when you are planning a project: the guidance, the article 4 position and the conservation area appraisal you are working to depend on which side you are on.
- Steep ground. Highgate Hill is a serious slope. Excavation, retaining structures and site logistics are all shaped by it, and so is the question of what happens to surface water during the works.
- Georgian fabric. Soft brick, lime mortar and lath and plaster, none of which behaves the way a modern detail assumes when it is cut or loaded.
- Narrow village streets. Delivery, scaffold and waste routes are tight, and the route often passes a listed frontage.

This is the CDM role, not the Building Regulations one
Since October 2023 England has had a second principal designer role, under Part 2A of the Building Regulations 2010. It is a separate appointment about designing to meet the Building Regulations, and ClearCDM does not provide it. Most projects that need one need both. The difference in full.

Who appoints the principal designer on a Highgate flat refurbishment?
The client, in writing, wherever more than one contractor is involved. If the flat is your own home you are a domestic client and regulation 7 moves most of your other duties to the principal contractor. If you are a landlord, the work is connected with a business and the full client duties in regulation 4 stay with you.
